Classii.mu terms and use

Welcome to Classii.mu
Classii.mu aims to further the development of classical music, providing a service to cultivate a community where fans can enjoy, learn about, and interact with each other over classical music.
These terms and conditions apply to the use of the services provided by Classii.mu.
Classii.mu is developed and provided by Scholex, represented by its CEO, Iwao Kobayashi.
While users can use Classii.mu for free, users agree to receive advertisements broadcasted by Classii.mu. We may use users' personal data to determine which advertisements to deliver to them. (For more details, please see Chapter 2.)
Article 1. Services
To achieve the objectives set forth at the outset, Classii.mu provides the following services:
1.1 Definition of Terms
The following terms used within the services provided by Classii.mu are defined as:
- Artist: This includes composers, conductors, performers, as well as orchestras and bands.
- Release: A compilation of multiple recorded audio tracks released in formats such as records, CDs, or digital distribution.
- Content: In Classii.mu's database, this includes information on artists, songs, releases, videos, and reviews. Additionally, news articles, event information, and advertising content may also be provided.
1.2 World-Class Classical Music Database
Classii.mu has built a specialized classical music database by uniquely arranging an open database supported by volunteers from around the world. Users can freely explore and access this information.
1.3 Collection and Review of Content
Users can search through a vast amount of content provided by Classii.mu (including information on artists, songs, releases, videos, and reviews) to find and bookmark their favorite content. Bookmarked content is displayed on a personal page, allowing for quick access anytime. Furthermore, users can write reviews for release and video provided by Classii.mu. These reviews are displayed on the user's personal page and can also be accessed from the respective content. Through Classii.mu, users can discover new content by reading reviews written by other users.
1.4 Interaction with Other Users
On Classii.mu, users can follow other users or send a "like!" reaction to reviews written by others. Activities by followed users will be prioritized on the home screen.
1.5 Posting Video Information
On Classii.mu, users can post video information related to artists or songs. Video information can be edited by users other than the one who initially posted it, similar to how Wikipedia is edited by the community. Currently, users cannot upload video content directly to Classii.mu. Instead, it displays content from third-party video sharing services. Please adhere to the rules and methods specified by those services when posting or using video content.
1.6 Addressing Harmful Behavior and Protecting & Supporting the Community
Classii.mu strives to create a community where all users can use the platform safely. Misusing Classii.mu to harm others or infringing on the rights of third parties is prohibited. If such content or behavior is detected, the company will take appropriate measures such as content deletion, service access restriction, account suspension, or consultation with law enforcement agencies. If you come across any such behavior, please report it to the operators promptly.
Article 2. Use of Users' Personal Data
2.1 Definition of Personal Data
In this agreement, personal data is defined as follows:
Personal data refers to information about an identified or identifiable natural person (the "data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, or an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Classii.mu has established a "Data and Privacy Policy" which provides more detailed scope, methods of use, and management of personal data. Please also refer to that document.
2.2 Operation of Advertisements
While users can use Classii.mu for free, they agree to receive banner ads, advertising content, and affiliate ads delivered by Classii.mu. These ads are disseminated by our company upon request from businesses and organizations that pay advertisement fees. To deliver ads that may be of interest to users, we may use the results of dynamic analysis based on user registration information and in-service activity.
The protection of users' privacy is of utmost importance when we design, implement, and operate our advertising system. Advertisers will not identify individuals using Classii.mu. Also, we do not sell personal data to advertisers or any third parties. Advertisers provide us with the attributes of their target audience and business objectives, and we consider those attributes when delivering ads. (For example, ads specific to a particular residence area)
Moreover, to measure the performance of ads within Classii.mu, we record how users respond to the delivered ads. We report aggregated data to advertisers, ensuring that the results do not identify individual users.
2.3 Notices Necessary for Operation
From time to time, we will send information that we deem important regarding the operation of our service, such as the release of new features, revisions of terms and policies, related services or products, requests for survey participation, feature improvements, discovery of issues, service maintenance, and significant content updates, to the email address users have registered with us. We also use this method to respond to inquiries from users.
Article 3: User Pledge
We offer services including Classii.mu to promote our stated mission. We require users to commit to the following:
3.1 Eligibility to Use Classii.mu
Responsible comments and actions by users contribute to a safe and enjoyable community. Therefore, users must adhere to the following:
- Users will create only one account for themselves.
- Users will provide accurate and truthful information during registration.
- Users will not share their passwords with others or allow others to access their accounts.
- Users will not transfer their accounts to others (unless with our permission).
While we aim to allow as many people as possible to use our service, the following individuals cannot:
- Those under the age of 13 (or those who haven't reached the legal age to use our products in their country).
- Individuals who have had their accounts suspended in the past for violating our terms or policies.
- Individuals prohibited by applicable law from using our services.
3.2 Content and Conduct Allowed on Classii.mu
We hope users express themselves and share their favorite content on Classii.mu, but this should not compromise the safety or welfare of others or the community. Users must agree not to engage in, or encourage or support similar conduct by others:
- Users are prohibited from using our product to:
- Engage in conduct or share content that violates our terms, guidelines, or other related policies.
- Engage in illegal, misleading, discriminatory, or fraudulent conduct.
- Infringe on the rights of others, such as intellectual property rights.
- Users are prohibited from uploading computer viruses or malicious codes, or from interfering with, overloading, or damaging the regular functioning or display of our services.
- Without our permission, users are prohibited from accessing or attempting to access our service data using automated means or data they are not authorized to access.
We can remove content that violates our terms or guidelines and limit access to such content.
If we determine that shared content by users violates our terms or guidelines, we may notify the user and request improvements. However, if violations are severe, repeated, or risk legal liability to us or others, harm the community, jeopardize the preservation or operation of our services, are constrained by technical limitations, or are legally prohibited, we may immediately remove such content and restrict the offending user's access to content, services, and information.
For a better community, please report any content or conduct that violates our terms or guidelines to the administrators.
3.3 Permissions regarding Classii.mu
In order to continuously offer our services and improve the quality of the experience, we need to obtain certain permissions from our users.
1. Permission concerning the use of content created and shared by users
Information registered and reviews posted by users may contain content that is protected under intellectual property laws.
Users hold intellectual property rights, such as copyrights established by various countries, for the content they post on Classii.mu. These terms do not contain any provisions that would deprive users of the rights they hold over their own content. Users are free to publish, edit, halt publication, download, or even make their content public outside of this service.
However, in order for us to provide the service, users must grant us a legal permission (commonly referred to as a "license") regarding the use of their content. As stated in Chapter 1, this permission from the user is solely for the provision and improvement of our services.
Specifically, when users post content on our service that is subject to intellectual property rights, they grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, distribute, modify, reproduce, publish, translate, and create derivative works from such content. This license ends once the user deletes their content.
Users can delete content individually or delete all content by removing their account.
When content is deleted, other users can't see it. However, in the following circumstances, content may still persist somewhere in our system:
- If immediate deletion is technically impossible (in which case the content will be deleted over time within these technical constraints).
- If someone else continues to use the content based on the license (in this case, the license remains in effect until that content is deleted).
- If immediate deletion would limit our ability to:
- Investigate or identify illicit activities or violations of our terms and policies (e.g., detecting or investigating misuse of our service or system).
- Comply with legal obligations such as preserving evidence.
- Comply with requests from judicial, administrative, law enforcement, or governmental agencies.
In these cases, the content will be retained until the need for its retention has ended. The exact retention period varies depending on the individual case.
For each of the above scenarios, the license remains in effect until the content is fully deleted.
2. Permission to use user's name, profile picture, and information regarding user's reactions to advertisements and ad content
Users grant us permission to use their display name, profile picture, and reactions on Classii.mu (such as "likes", "bookmarks", page views) related to advertisements, coupons, or other ad content presented across our products without compensation. For instance, reactions by users are listed chronologically on a dedicated user page, visible to other users. Content reacted to by followed users is prominently displayed on the site's homepage. Reactions to ad content are processed in aggregate and reported to advertisers. (No personally identifiable information is provided to advertisers.)
3-4. Restrictions on the use of intellectual property
When using content that is subject to intellectual property rights (such as images, designs, videos, audio, and text) provided on our service, all rights related to that content (excluding rights owned by the user) remain continuously with us. Users can use our copyrighted materials or logos only if they obtain prior written permission from us. If a user wishes to modify our source code, create derivatives, decompile, or conduct any other operations extracting our source code, they need our permission.
Article 4. Additional Provisions
4-1. Revision of the Terms
We continuously strive to improve our service and develop new features to provide a better experience for our users and community. Consequently, there may be times when we need to update these terms to accurately reflect our services and operational status. If certain provisions become inadequate, have discrepancies, or if changes are deemed reasonable for the benefit of users, we reserve the right to modify these terms.
We will notify users of any changes to these terms at least 30 days prior to their implementation by means such as posting on our website or sending emails. This will ensure that users have ample opportunity to review the revised terms before they take effect. However, this does not apply to changes required by law. Once the revised terms become effective, continuing to use our services signifies acceptance and agreement to be bound by the updated terms.
We value our users and wish for them to continue using our services. However, if a user does not agree with the revised terms and wishes to withdraw from the Classii.mu community, they are free to delete their account at any time.
4-2. Temporary Suspension or Deletion of Account
If a user is determined by us to have committed a clear or serious breach of our community guidelines, terms, or policies, or repeatedly violates them, we reserve the right to temporarily or permanently suspend access to their account. Likewise, if a user repeatedly infringes on the intellectual property rights of others, or if there are legal reasons necessitating such action, we can suspend the user's account either temporarily or permanently.
Should we take such measures, we may notify the user and request corrective actions. However, we may exclude notifications and requests if they would incur legal liability on our part or on the part of others, harm the user community, compromise or interfere with the maintenance or operation of our services, systems, or products, or if such notifications and explanations are technically constrained or prohibited by law.
If your account has been suspended and you believe it was done so in error, or if you wish to know the procedures regarding a suspended account, please contact the administrator.
Upon deletion of a user's account by the user or suspension by us, the effectiveness of these terms as an agreement between the user and us is terminated. However, the provisions of Article 3, and clauses 2 to 5 of Article 4, shall remain effective thereafter.
4-3. Limitation of Legal Liability
Classii.mu aims to provide the best service possible and strives to establish clear guidelines for all users. However, it must maintain its services amidst ever-changing societal conditions. This can be deemed inevitable, especially given today's web systems which are constructed and operated by integrating numerous intricate components such as software and infrastructure.
We do not guarantee that the service will always be safe, reliable, or error-free, or that it will function without disruptions, delays, or imperfections. To the extent permitted by law, we disclaim all warranties, whether expressed or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We neither control nor direct user actions, and we are not responsible for their actions, behaviors, or any content they share, be it offensive, inappropriate, obscene, illegal, or otherwise objectionable.
We cannot foresee when issues might arise with our service. Due to this, our legal liabilities will be limited to the maximum extent allowed by applicable law. Under no circumstances shall we be legally liable for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to this agreement or Classii.mu, even if we have been advised of the possibility of such damages.
4-4. Disputes
We strive to provide clear provisions to minimize the occurrence of disputes between us and our users. However, if a claim is made, it's beneficial to understand beforehand where and under which law it will be resolved.
This agreement shall be governed by the laws of Japan. For any litigation related to our services between us and our users, the Yokohama District Court shall have exclusive jurisdiction as the court of first instance. If the user qualifies as a consumer, it is agreed that any claims, lawsuits, or assertions against us arising out of or related to this agreement or Classii.mu, including our other services, shall be brought under the jurisdiction stipulated by Japanese law.
Disputes arising between users, between third parties, between users and third parties, or between the user or users and a third party, through this service shall be resolved among the parties involved. Users agree not to make any complaints or claims for damages or the like against us.
4-5. Miscellaneous
- This agreement constitutes the complete agreement between the user and us regarding the use of our services. This agreement takes precedence over any agreements made before its enactment.
- If any provision of this agreement is found to be unenforceable, the remaining provisions will continue to be in full force and effect. If we fail to enforce any provision of this agreement, it will not be considered a waiver. Any modifications to this agreement or waivers must be in writing and signed by us.
- Users cannot assign their rights and obligations under this agreement to others without our consent.
- If a user is determined to be incapable of managing their account due to death, illness, or any social reason, the individual specified in a valid will or similar document may request disclosure of the account's contents.
- This agreement does not establish any beneficial rights for third parties. All of our rights and obligations under this agreement can be freely transferred by us, whether through merger, acquisition, asset sale, or the application of the law.
- Under certain circumstances, we may need to change a user's account username. (For example, if a user falsely registers an account under the name of a real artist and disseminates information, causing clear disruptions to the artist's activities.) If this action is taken, we will notify the user beforehand.
- We welcome feedback and suggestions from our users regarding our services. However, please understand that we can use them without any restrictions, without the obligation to compensate, and without the obligation to maintain their confidentiality.
- We reserve all rights that are not expressly granted to users in the use of our services and website.
Article 5. Other Terms and Policies Applicable to Users

- Cookie Policy: This explains how we deal with cookies in the services we provide.
